Builders must complete civic amenities before offering possession – Haryana Government




                                                       

Builders of Licensed colonies will no longer be able to take property buyers, including apartment owners, for a ride by offering possession without the completion of development works. The Haryana Government passed an Order to this effect and further stated that the Builders will have to make provision of civic amenities before offering possession of flats to the buyers. 

The Director General, Town and Country Planning Department of the State Government informed that the official concerned would be accountable for enforcing the order; and further stated that the District Town Planner (DTP) and the Executive Engineer of HUDA (XEN) concerned will have to inspect the site before submitting their report and also have to certify the completion of development works and fitness of several blocks of the building for occupation, in all respects. 


§ The concerned Officials are required to send 10 photographs, videography of development works, before issuance of occupation certificate 

§ The District Town Planner (DTP) and the Executive Engineer of HUDA (XEN) are required to inspect the site before submitting their report for issuance of occupation certificate. 

§ Rainwater harvesting and water supply to be ensured before the possession of plots, flats and apartments. 

§ Metalled roads, standby generators, internal lighting must be completed before possession. 

The concerned Officials are required to submit “at least 10 photographs of each building signed by the Officials concerned and videography of the buildings and development works completed at the site, along with the site report. The Officials are also required to ensure that all public health works, including rainwater harvesting, were operational in the Apartment building complex. They should also ensure that, besides the availability of water supply, including through water tankers arranged by the developer and water sourced from the HUDA would have to be ensured before the issuance of Occupation Certificate to the developer. 

The State Government further directed through its order that the District Town Planner (DTP) concerned would ensure that standby generators are provided for lifts; and now for issuance of Occupancy Certificates, the site should be approachable from a metalled road. Besides these, the Officials would ensure that compact fluorescent lamps fittings for internal lighting and campus lighting are provided by builders. To ensure compliance of the order, the Senior Town Planner (STP) concerned will inspect atleast 25 percent of the cases. More over, the STP (Headquarters) will randomly check 5 percent of the cases to see that all the development works have been completed before issuance of the Occupation Certificate.
